What is the HCBS Settings Rule?
The Home and Community-Based Services, or HCBS, Settings Rule is a set of federal requirements created by the Centers for Medicare & Medicaid Services (CMS) in 2014.
The rule applies to services provided in home and community-based settings and is intended to ensure that people receiving services have the same rights, choices, and community opportunities as people who do not receive services.
The goal of the HCBS Settings Rule is to ensure that individuals receiving Regional Center services:
- Are treated with dignity, respect, and privacy.
- Have meaningful choice and control over their daily lives.
- Are supported to make decisions about where they live, work, spend time, and receive services.
- Have opportunities to participate fully in community life.
- Receive services in settings that are integrated, person-centered, and least restrictive.
- Are supported in a way that reflects their preferences, culture, communication style, and personal goals.
